General Waiver, Release and Contract

Thank you for choosing Bad Girls Yoga for your group yoga experience! 

The services to be provided by Bad Girls Yoga to Client are fitness class services (“Client services” or “services”).

Please read this General Waiver, Release and Contract (the “Contract”) carefully. By signing the Contract, you hereby represent and warrant that you release Bad Girls Yoga from all liabilities and assume all risks when booking services and working with a wellness practitioner as stated below.

Appointments, Cancellation, and Deposit

All Client services are by appointment only and are typically provided in a class setting. These class appointments are reserved for Clients. 

Notice of cancellation of services must be provided seven (7) days prior to the date services are to be rendered, calculated to include the date of services as one of the seven days. Bad Girls Yoga will bill Client in full for a missed appointment or an appointment which is not cancelled with the seven-day notice as provided for herein.

Client is expected to be available, prepared, and punctual for all appointments. A $100 deposit is due at the time of booking and is non-refundable.

Payment

Payment for services is due no later than seven (7) days prior to the date on which services are to be rendered, including within this seven-day period the date on which services are to be rendered. Payment is non-refundable, except as provided for herein.

Acknowledgement of Risks

In physical activity, risk of serious injury is possible. Likewise, yoga may involve a test of your physical and mental limits and may carry the potential for injury. Risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, practitioner, and equipment.

Bad Girls Yoga services are in no way a substitute for medical diagnosis or treatment. By signing below, you acknowledge you aware of the physical risks involved with exercise and understand that it is your personal responsibility to consult with your doctor regarding participation. You represent that you have no medical condition of which you are aware that would prevent you from taking part in any of the classes or workshops, and you assume responsibility for any risk or injury that you may sustain as a result of your participation, including but not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, or economic or emotional loss. You further acknowledge your understanding that these injuries or outcomes may arise from Bad Girls Yoga’s own negligence. Nonetheless, you agree to assume all related risks, both known and unknown, with the exception of those risks created by Bad Girls Yoga’s reckless and/or wanton conduct.

Assumption of Risks and General Release

By signing below, you knowingly and freely assume all risks associated with Bad Girls Yoga’s services, both known and unknown and including those risks arising from Bad Girls Yoga’s own negligence, and assume full responsibility for my participation. 

Furthermore, in signing below, you, for yourself and on behalf of your heirs, release and hold harmless Bad Girls Yoga, its affiliates, owners, employees, successors, officers, representatives, and assigns (together, “Affiliates”), in their individual and corporate capacities with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by the negligence of Bad Girls Yoga or its Affiliates, except that which is the result of gross negligence and/or wanton misconduct the and from any and all claims, and further from any and all claims, lawsuits, liabilities, obligations, promises, agreements, disputes, demands, costs, damages, judgments, or causes of action arising out of or related to the services of Bad Girls Yoga.

Media Release

By participating in any of Bad Girls Yoga’s services, you agree to grant Bad Girls Yoga the right to use your image, likeness, photos, video content and audio recordings captured of you on Bad Girls Yoga websites, social media, publicity, and marketing. 

COVID-19 Release

Bad Girls Yoga takes strict measures to prevent the spread of COVID-19; notwithstanding, you hereby acknowledge that participating in any of Bad Girls Yoga’s services could result in exposure to and contraction of COVID-19. By signing below, you assume any risk, take full responsibility, and waive any and all claims of personal injury or death relating to COVID-19 infection from participation in the services, contact with other participants, or use of shared space, surfaces, or equipment. You understand and agree that Bad Girls Yoga may disclose your personal information to relevant authorities as required by law and policies related to the containment of COVID-19 through contact-tracing or for other lawful purposes.

Non-Disparagement

You agree not to make, publish, or communicate to any person or entity, in any media or public forum, including on any social media or user-generated content sites, any comments or statements (written or oral), that intentionally or unintentionally would, or is reasonably likely to, disparage, create a negative impression of, or is in any way detrimental to Bad Girls Yoga (as determined by us in our sole discretion), its Affiliates, services, employees, customers, or other associated third-parties. By signing this contract you certify that you are at least 18 years of age or older and that you have the right to enter into this General Release and Waiver Form.

Choice of Law and Forum Selection

You agree that this Contract shall be interpreted and enforced according to the laws of the State of South Carolina, and that litigation of any and all claims related to or arising out of this Contract shall be exclusively in the state or federal courts of Charleston County, South Carolina.
